EUROPEAN JEWISH ASSOCIATION LAMENTS EUROPEAN COURT OF JUSTICE RULING ON KOSHER SLAUGHTER IN BELGIUM “WHAT A TERRIBLE MESSAGE TO SEND TO EUROPEAN JEWRY – YOU AND YOUR PRACTICE ARE NOT WELCOME HERE” SAYS ITS CHIEF.

(Brussels 17 December 2020) The European court of Justice today delivered a potentially devastating ruling on an issue that has plagued European Jewry for years, the right to slaughter animals in the Kosher tradition, a millennia old practice that puts animal welfare and minimizing animal suffering at its very core.
Rabbi Menachem Margolin, Chairman of the EJA today said his organisaton will explore every avenue and recourse available to protect the rights of Jews everywhere in Europe,
“This is a sad day for European Jewry. For decades now, as animal rights have come into vogue, Kosher slaughter has come under relentless attack, and subject to repeated attempts to ban it. The entire basis of the attacks are built on the entirely bogus premise that Kosher slaughter is more cruel than regular slaughtering, despite there being not a shred of evidence backing this up, and worse completely ignoring the fact that Kosher slaughter puts the welfare of the animal and minimising its suffering as of paramount importance. This is not a glib staement, but a commandment that all Jews must adhere to.
“What today’s ruling does is put animal welfare above the fundamental right of Freedom of Religion. Simply put, Beast takes preference over man.
Potentially devasting too, it gives other European countries like Belgium – who similarly regard this fundamental Charter freedom as ‘negotiable – the green light to follow suit. If every european country does it means only one thing: there will be no Kosher meat available in Europe anymore.
“What a terrible message to send to European Jewry, that you and your practices are not welcome here. This is a basic denial of our rights as European citizens. We cannot let it stand and will pursue every recourse and avenue to ensure that it doesnt.”
The European Court of Justice has ruled on a Belgian case, involving Flanders and Wallonia laws, that require pre-stunning of animals before slaughter. In short, the Court says that individual Member State moves to ban kosher slaughter by making stunning a pre-requisite, do not in themselves violate the Freedom of Religion rights contained within the EU charter of Fundamental Rights.
The ruling runs contrary to an opinion given in early September 2020 by the European Court Advocate General who suggested the oppositea.

As a rabbi, I prefer not to get involved in politics and my opinion is that a politician should not interfere with religion. But where does politics start and where do rabbinical matters end? Is euthanasia a religious matter or a political problem? And who decides how far freedom of education extends?
That difference is even more unclear in Israel, because: “Israel without Torah is like a body without soul”, one can’t separate the State of Israel from Judaism. And therefore, we see in the Knesset politicians with rabbinical opinions and rabbis as politicians.
But even the Jew who is not an Israeli resident has the conviction that he may state his opinion and interfere with Israeli political decisions because, he argues, without centuries of daily prayers in which we asked G’d to allow us to return to Jerusalem, Israel would not be today an Independent State. However, my opinion is that just as the Israeli citizen does not make statements about the Dutch Prime Minister, Rutte, we, not living in Israel, shouldn’t interfere in internal Israeli politics.
However, non-Jewish society sees us as an extension of Israel. Over and over again, I have to explain that I am Dutch and that the compliment that my Dutch is so fluent, is misplaced. You’re not going to give that compliment to the bishop or the preacher, do you? But in according with their opinion “the Jew is Israel and Israel is the Jew”.
And yet there is a heart of truth in their falsehood, for Jews know themselves interconnected by Jerusalem, our capital, where one day the Third Temple will rise when the ultimate peace will be there “for all inhabitants of Your earth.”
And until then? When Netanyahu called upon French Jews to emigrate to Israel because of anti-Semitic violence, I was pushed in front of a journalist’s microphone and was asked, “Rabbi, what do you think of Netanyahu’s call? Do you really believe that there is no place for Jews in the Netherlands anymore?” Wow, I thought, that’s a tricky one. It is not possible to request time for reflection, to say that Jews no longer belong in Europe is unwise and disagree in public with Netanyahu does not seem right. And therefore, my diplomatic, rabbinical and politically coloured answer was: Great we have got Israel for all those who must escape anti-Semitism. My parents had nowhere to go. But if and when I go on aliyah, will not be determined by fear for terrorism. I decide for myself, because I am independent, like the State of Israel!

Paris Mayor, Anne Hidalgo, has inaugurated an alley bearing the name of Mireille Knoll, a 85-year-old Holocaust survivor who was brutally murdered in her apartment in a antisemitic attack.
The alley is located on the Boulevard de Ménilmontant, in the 11th arrondissement of the French capital.
Knoll was brutally murdered in her apartment in a antisemitic attack on March 23, 2018. Firefighters who arrived at Knoll’s building later that night to answer an emergency call discovered her partially-burned body with 11 stab wounds.

It was another week of sorting through my stuffed inbox. A nice surprising was the initiative of an unknown person who only has a Jewish father. He wants to set up a website entitled: “ask the rabbi”.
 
I thought it was nice that someone who is therefore according to Halachah non-Jewish approached me to do this. So, I immediately made contact and agreed to participate.
 
The intention is that people ask their question online and that the administrator, him in this case, then forwards the questions to one of the participating rabbis. It seems sensible to me that some sort of pre-selection takes place, but although he thought the questions would be limited to questions about knowledge, I expect many more requests for help.
 
A request for help is very difficult to answer in writing. And so my proposal is that the rabbi call the questioner from an unnamed number. Experience has taught me that most of the questions that come to me are dressed up in a simple factual question, but that behind that simple question lies a much deeper question or problem. I cannot perceive this problem if the question is asked in writing.
 
And so the webmaster gets to work and looks at how we can separate the wheat from the chaff, but at the same time not throw the baby away with the bath water. I’m curious! So although I got up too late, because I went to bed much too late, my working day became too short. Especially because I had to come to Veldhoven to take part in an Israeli broadcast debating anti-Semitism and the question of how politics deals with Israel. And that was, despite first glance, fun.
 
I had brought to my friend Louk de Liever a bottle of Israeli wine specially from Judea and Samaria, which has been bombarded by the anti-Jewish lobby into a so-called ‘occupied area’ and these products must be provided with a label on which the origin can be recognised. So, product of Israel is of course out of the question, but also coming from Judea and Samaria is not accepted. It should read product from “occupied territory”. And while I had just returned from the city centre of Amersfoort, where Louk lives, after my walk, I see a message that in Dubai products from the so-called “occupied territories” may be sold without a label because they support the Palestinian economy. I am curious if the United Nations will now pass a resolution against the United Arab Emirates and I am even more curious how our Ministry of Foreign Affairs will respond.
 
Are they now sending a number of employees to fine the Chamber of Commerce in Dubai, as they did a few months ago to Nijkerk? Making sure that animal suffering in the slaughterhouses was limited, there was not enough staff available for that, but those few bottles of delicious Israeli wine from the “occupied territories” apparently had enough time and staff and that was really much more important than unnecessary animal suffering…But even if that reporting isn’t correct yet, it doesn’t matter. Because in politics, today’s truth can be tomorrow’s lie, or vice versa!
At 6:00 PM left for Veldhoven, near Eindhoven, for the Israel evening. It started at 8:00 PM and lasted until 9:15 PM. What a great program, what energy the SGP has put into this.
 
What pro-Israel warmth. And how grateful I am that I was able to participate in this. The background was a large photo of Jerusalem with the burning menorah in front of it. Perfect music, live interview with someone from Israel and someone else from Iraq. It was amazing.
 
But of course I had to think about what to say. It takes energy, but thank G-d I have that. At 11:15 PM I was home, floored. Wrote the diary and had another conversation with a political person to try to get a visa for a father who lives in Israel, is divorced and wants to visit his two small children, who live with his ex in the Netherlands. Problem: Visa is not granted due to corona. The political insider will see what he can do.
